A driver failed to yield the right-of-way to a cyclist at a triangle intersection in Mariposa County, striking the cyclist and causing multiple injuries, including fractured ribs and collarbone, road rash, and a leg injury.
Partner Gerald Agnew successfully concluded litigation for the maximum insurance limits of the offending driver, as well as the maximum underinsured motorist benefits of the cyclist. If the cyclist had not had underinsured motorist coverage, the settlement would only have been $15,000; however, thanks to the cyclist's coverage, Mr. Agnew was able to negotiate medical and hospital bills to a minimum and obtain a further $85,000 settlement from the cyclist's insurance provider, the maximum recovery available.
