A negligent pickup truck driver in Sun Valley, Idaho turned right from a residential street onto the main road, crossing a two-way bike path and striking a cyclist. Partner Gerald Agnew successfully litigated a lawsuit on behalf of the cyclist and obtained a settlement for the severe shoulder injuries sustained by the cyclist in the accident.
Though liability was disputed, the driver ultimately paid a settlement of $325,000 for the cyclist's injury. Mr. Agnew cites his opportunity to get on the case early and get a complete reconstruction of the accident, as well as to maintain all physical evidence, as contributing factors to his success in this case.
AgnewBrusavich was particularly pleased with the result because personal injury damages in Idaho are capped at $250,000.
